1. Acceptance of Terms

By accessing and using Mathemy (“the Service”), operated by Vestra AI ehf. (“we,” “our,” or “us”), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Mathemy is an advanced graphing calculator web application that provides:

• Interactive mathematical function graphing
• Data visualization and regression analysis
• Calculus operations (derivatives and integrals)
• Unit circle visualization
• AI-powered mathematical assistance (requires authentication)

3. User Accounts and Authentication

3.1 Age Requirements

By creating an account, you represent and warrant that you meet the minimum age requirements. If you are under the required age, you may only use the Service with the involvement and consent of a parent or legal guardian.

Parental Consent: If you are a parent or guardian and discover that your child under the required age has created an account without your consent, please contact us immediately at vestra@vestra.is, and we will delete the account.

3.2 Account Creation

To access AI features, you must create an account through our authentication provider, Clerk. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate and current
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access
• Confirm that you meet the minimum age requirements

3.3 Account Termination

We reserve the right to terminate or suspend your account at any time for violations of these Terms, including but not limited to:

• Providing false age information
• Abusive behavior or harassment
• Fraudulent activity
• Misuse of the Service or AI features
• Violation of applicable laws

4. AI Features and Usage

4.1 AI Assistant

The AI chat assistant is powered by OpenAI's GPT-4.1-mini model. You acknowledge that:

• AI responses are generated automatically and may contain errors
• The AI should not be used as the sole source for critical calculations
• Mathematical results should be verified independently when accuracy is critical
• The AI assistant is for educational and informational purposes only

4.2 Rate Limits

We may implement rate limits on AI features to ensure fair usage and manage costs. Excessive use may result in temporary restrictions.

4.3 Content Moderation

We reserve the right to monitor AI chat usage and may restrict or terminate access for:

• Attempts to bypass safety measures
• Abusive or harmful content
• Automated or bot-driven usage
• Commercial exploitation without permission

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated means to access the Service without permission
• Share your account credentials with others
• Use the Service to transmit malicious code or harmful content
• Violate the intellectual property rights of Mathemy or others

6. Intellectual Property

6.1 Service Content

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, software, and design, are owned by Vestra AI ehf. and are protected by international copyright, trademark, and other intellectual property laws.

6.2 User Content

Mathematical expressions, functions, and data you input into the Service remain your property. However, you grant us a license to process this data to provide the Service.

6.3 AI-Generated Content

Content generated by the AI assistant is provided “as is” without any warranties. You are responsible for verifying the accuracy of AI-generated mathematical solutions.

7. Third-Party Services

The Service integrates with third-party providers:

• Clerk - Authentication and user management
• OpenAI - AI chat functionality
• Vercel - Hosting and deployment (if applicable)

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

8. Data Processing and Storage

We process and store the following data:

• Account information (managed by Clerk)
• AI chat conversations (temporarily processed, not permanently stored)
• Usage analytics and performance metrics
• Error logs and debugging information

Mathematical calculations are performed client-side in your browser when possible. AI features require server-side processing through OpenAI's API.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of calculations or AI responses
• Uninterrupted or error-free operation
• Security or absence of harmful components

Educational Use Only: This Service is intended for educational and informational purposes. Do not rely solely on Mathemy for critical calculations, examinations, professional work, or any situation where errors could result in harm or loss.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MATHEMY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from reliance on calculations, graphs, or AI responses
• Unauthorized access to or alteration of your data
• Statements or conduct of any third party using the Service
• Any other matter relating to the Service

You agree to indemnify, defend, and hold harmless Mathemy and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Violation of these Terms
• Violation of any rights of another party
• Content you submit or generate through the Service

12. AI-Specific Terms

12.1 AI Usage Restrictions

When using AI features, you agree NOT to:

• Attempt to extract, replicate, or reverse-engineer the AI model
• Use the AI for prohibited purposes under OpenAI's Usage Policies
• Generate or request harmful, illegal, or inappropriate content
• Use the AI commercially without explicit permission
• Automate requests to the AI or use it programmatically

12.2 AI Accuracy

AI-generated mathematical solutions, explanations, and graphs may contain errors or inaccuracies. Always verify critical calculations independently. We make no guarantees about the correctness of AI outputs.

12.3 AI Data Usage

Conversations with the AI assistant may be processed by OpenAI according to their data usage policies. While we do not permanently store your chat history, OpenAI may retain data according to their policies.

13. Modifications to Service and Terms

We reserve the right to:

• Modify or discontinue the Service (or any part) at any time with or without notice
• Update these Terms at any time
• Change pricing or introduce fees for features (with notice)

Continued use of the Service after changes constitutes acceptance of the modified Terms. We will notify users of material changes via email or prominent notice on the Service.
